These terms are an agreement between you and IT Support 101 Inc. ("we", "us"), the company that runs My Company Trivia. By creating an account, or by using the service on behalf of an organization, you agree to them. If you're accepting for an organization, you confirm you're allowed to bind it, and "you" means that organization.
1. The service
My Company Trivia lets organizations run live quizzes, self-paced training, campaigns and displays on screens. People who play a live game don't need an account. People who sign in, such as admins, hosts and team members, do.
2. Accounts
- Give accurate information and keep your password to yourself. You're responsible for what happens under your account.
- Admins in an organization decide who joins it, what role they have, and what content is used. Admins are responsible for the people they invite.
- You must be old enough to enter a contract where you live to create an account.
- Tell us straight away at [email protected] if you think someone has got into your account.
3. Plans, trials and payment
- Plans and prices are shown on our pricing page. Customers in Canada pay in Canadian dollars, plus applicable sales tax. Everyone else pays in US dollars.
- Paid plans renew automatically each month or year until canceled. You can cancel at any time from Billing, and the plan stays active until the end of the period you've paid for.
- Except where the law requires otherwise, payments aren't refundable, including for partly used periods.
- A free trial lasts for the period shown when you sign up, and needs no card. When it ends, the organization keeps its content, but some features stop until a plan is chosen.
- License keys give a plan for the period stated with the key, starting when the key is entered.
- We may change prices. We'll give at least 30 days' notice by email or in the service, and the change applies from your next renewal.
- Card payments are handled by Stripe. We never see or keep full card numbers.
4. Acceptable use
You agree not to use the service to:
- break the law, or help anyone else break it;
- upload or share content that is hateful, harassing, sexually explicit, violent, or that you don't have the right to use;
- upload malware, or try to get around security, access other organizations' data, or overload the service;
- collect personal information about players beyond what the service is for;
- resell the service without our written agreement.
We may remove content or suspend access that breaks these rules. Where it's reasonable, we'll tell you first.
5. Your content
Quizzes, questions, pictures, video, sound and results you create or upload ("your content") stay yours. You give us permission to store, copy and display your content only as needed to run the service for you, including in encrypted backups. We don't use your content to train artificial intelligence models, and we don't sell it.
You confirm you have the rights to anything you upload. Photos have their location and camera details removed when they're uploaded.
6. Our content
The quiz library, question packs, training templates, designs and software belong to us or our licensors. While you have an account, you may use them and copy them into your organization's quizzes, for use within your organization. You may not republish them as a product of your own.
7. Training content
Training templates and question packs are general awareness material. They are not legal, safety, security or other professional advice, and they don't replace training that the law or your industry requires, such as workplace-specific WHMIS training. You're responsible for checking that any training you give meets your own obligations, and for adapting it to your workplace.
8. Privacy
Our privacy policy explains how we handle personal information. For the personal information of your staff and players, our data processing terms also apply and form part of this agreement.
9. Availability and changes
We work to keep the service running and secure, but we can't promise it will always be available or free of errors. We may need to pause it for maintenance, ideally outside business hours. We may improve or change features. If we remove something important to paying customers, we'll give reasonable notice.
10. Ending the agreement
- You can stop using the service at any time, and an admin can delete the organization under Your data.
- We may suspend or end access if you seriously or repeatedly break these terms, or don't pay. Where possible we'll warn you first and give you a chance to fix it.
- When an organization is deleted, its data is removed from the live service straight away. Copies in our encrypted backups are deleted as those backups expire, within 12 months.
11. Warranties and liability
The service is provided "as is". To the extent the law allows, we disclaim all implied warranties, including that the service is fit for a particular purpose.
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits or lost data, and our total liability for any claim is limited to the amount you paid us for the service in the 12 months before the claim arose. Nothing in these terms limits liability that can't be limited by law.
12. Indemnity
You agree to cover our reasonable costs if a third party makes a claim against us because of your content or your breach of these terms.
13. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction over any dispute.
14. Changes to these terms
We may update these terms. For changes that matter, we'll give at least 30 days' notice by email or in the service. Continuing to use the service after a change takes effect means you accept it.
